Immigration services offered by our firm are provided by Regulated Canadian Immigration Consultants (RCICs) licensed and in good standing with the CICC pursuant to the College of Immigration and Citizenship Consultants Act (S.C. 2019, c. 29, s. 292).

2. No Legal Advice & No Consultant-Client Relationship

• No Automatic Relationship: Browsing this site, submitting a web form, or completing an evaluation profile does not create a consultant-client relationship between you and OA CLARKE IMMIGRATION SERVICES INC.
• Mandatory Written Retainer: Professional representation and advice begin only after a formal Initial Consultation Agreement or Professional Services Retainer Agreement is executed in writing and signed by both the client and an authorized RCIC.

3. Accuracy & Government Regulatory Changes

While we make reasonable efforts to maintain current information, Canadian immigration legislation, Comprehensive Ranking System (CRS) score cut-offs, processing fees, and policies established by Immigration, Refugees and Citizenship Canada (IRCC), Employment and Social Development Canada (ESDC), and Ontario Ministry of Labour, Immigration, Training and Skills Development change frequently and without notice.

OA CLARKE IMMIGRATION SERVICES INC. does not warrant that general website content will always reflect the most recent statutory or regulatory updates.

5. Consultation Fees & CICC Client Account Regulations

Where paid initial consultations are booked via our website:

• CICC Compliance: All unearned consultation fees collected prior to service delivery are managed in strict compliance with the CICC Client Account Regulation and Code of Professional Conduct.
• Cancellations & Rescheduling: Notice to cancel or reschedule must be provided at least 24 hours prior to the appointment time. Completed consultation services are non-refundable.

6. Limitation of Liability

To the maximum extent permitted by applicable federal and provincial laws, OA CLARKE IMMIGRATION SERVICES INC., its directors, officers, employees, and licensed RCICs shall not be liable for any indirect, incidental, or consequential damages resulting from your use of general website information or processing delays/refusals by IRCC or provincial immigration authorities.

Nothing in these Terms limits or excludes any statutory consumer rights or statutory obligations that cannot be lawfully excluded under Ontario consumer protection legislation.

7. Governing Law & Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
